Pay Provisions for Interns

This article accompanies Taking Them Seriously.

The U.S. Department of Labor has set forth some factors to determine whether interns need to be paid minimum wage and overtime.

According to this fact sheet, interns must be paid when an employer uses interns as substitutes for regular workers or to augment its existing workforce during specific time periods.

The fact sheet also lists the factors the DOL will use to determine whether an employment relationship with the intern exists under the Fair Labor Standards Act.
